The petitioner is languishing in custody in a case registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by all her in-laws family members including the petitioner for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the deceased. There is general and omnibus allegation
Patna High Court CR. MISC. No.62531 of 2023(3) dt.18-12-2023 2/2 against the petitioner. There is no prior complaint regarding any torture or demand of dowry against the petitioner. In fact, the victim was a quarrelsome lady and in the background of some petty dispute, she committed suicide. The postmortem report also suggest that victim has committed suicide. The petitioner is languishing in custody since 14.06.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IInd, Muzaffarpur, West in connection with Motipur P.S.
