JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bihta Police Station Case No. 58 of 2015 registered for the offences punishable under Sections 147, 149, 341, 323, 504, 353, 224 and 225 of the Indian Penal Code.

According to prosecution case itself, when the alleged occurrence took place, the petitioner was in custody of police in connection with Bihta P.S.Case No. 44 of 2015 and there is no accusation in the written report that petitioner instigated others to get him free from the clutches of the police. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is

Patna High Court Cr.Misc. No.9635 of 2015 (2) dt.10-03-2015 2/2 allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur at Patna in Bihta Police Station Case No. 58 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
