2. Counsel for the petitioner submits that the present M.J.C. application has been filed for compliance of the order dated 26.04.2023 passed in State of Bihar and Ors. Vs.Surendra Singh and Ors. Vide Cr.W.J.C. No. 416 of 2023.

3. Counsel submits that the said order has been disposed of in the light of the order passed in Cr.W.J.C No. 153/2017.

4. Learned counsel for the State intimated this Court that the case of State of Bihar and Ors. Vs.Surendra Singh and Ors. has been challenged in S.L.P. (Criminal) Diary No. 4297/2023 in which it has been ordered by Hon'ble Supreme Court vide order dated 04.05.2023 that proceeding in contempt

Patna High Court MJC No.2544 of 2023(3) dt.16-02-2024 2/2 shall not be initiated or continued by the High Court.

6. Counsel for the petitioner submits that he had received counter affidavit in which Hon'ble Supreme Court has stayed the order issued in contempt.

7. As such, this M.J.C. application is permitted to be withdrawn with liberty to the petitioner that after disposal of S.L.P. (Criminal) Diary No. 4297/2023 he shall file the fresh M.J.C.

8. Accordingly, the present M.J.C. is hereby dismissed as withdrawn.
