2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Kahalgaon P.S. Case no. 284 of 2024 instituted for the offence under Sections 147, 323, 341, 324, 307, 325, 504 and 506 of the Indian Penal Code.

3. The prosecution case is that all the accused persons arrived at the plot of the informant and started assaulting him indiscriminately. The specific allegation is against one Ranjan Kumar is that he assaulted with 'iron rod' on the right hand of Purushtom Kumar, he got fractured injury.

4. Learned counsel for the petitioners has submitted that petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that there is also a counter case which was filed before the present one. On perusal of the FIR, it is clear that there is no specific allegation against these petitioner and it seems to be a case of free fight between the parties. It is further submitted that petitioner nos. 1 ,2 and 7 are having one criminal antecedent whereas rest of the petitioners have no criminal antecedent.

5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Kahalgaon P.S. Case no. 284 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
