Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehend his arrest for the offences alleged under Sections 341, 323, 324, 307, 354, 427 and 504/34 of the of the Indian Penal Code, registered in connection with Biraul P.S.Case No. 83 of 2021.

Learned counsel for the petitioner has submitted that there is case and counter case and the petitioner has also sustained grievous injury.

The specific allegation against the petitioner is that he

Patna High Court CR. MISC. No.69926 of 2021(2) dt.27-07-2022 2/2 assaulted Subhash Yadav with an axe on his head. The injury sustained by Subhash Yadav is grievous in nature. The petitioner is the author of that injury.

In view of allegation, the petitioner does not deserve anticipatory bail. He is directed to surrender and seek regular bail before the court below, that shall be disposed of on its own merit. The learned court below may take notice of the fact that the petitioner has also suffered grievous injury and he is a person of clean antecedent.

With these observations, the application is disposed of.

Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
