The petitioner is languishing in custody since 24.12.2014 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. The prosecution case is that on 28.05.2014 the informant's husband went outside after conveying the informant that co-accused Kayum and this petitioner called him, he went outside the house. On the next day at 4.00 P.M. the informant heard about lying of a dead body in a water channel. The informant went near the water channel and identified the dead body of her husband.
It is submitted by learned counsel for the petitioner that only on the basis of circumstantial evidence the
Patna High Court Cr.Misc. No.10848 of 2015 (03) dt.06-07-2015 2/2 petitioner has been sought to be implicated. Admittedly there is no eye witness to the occurrence and similarly situated co-accused Kayum has been granted bail vide Cr. Misc. No. 40471 of 2014. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea in connection with Jalalgarh P.S.
