Petitioners apprehend their arrest in connection with Bajpatti P.S. Case no. 219/2014 registered under sections 307, 379 and other allied sections of the IPC.
It would appear from perusal of the impugned order that injured sustained altogether four injuries, out of them three injuries were found simple in nature and opinion regarding one injury was kept reserved till receipt of CT Scan. Annexure 3 to this petition reveals that in CT Scan, no bone injury was found and everything was found normal.
The contention on behalf of the petitioners is that parties have already compromised this case and so far as allegation of theft is concerned, the same is nothing but super addition.
Patna High Court Cr.Misc. No.9955 of 2015 (2) dt.13-03-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Pupari at Sitamarhi in Bajpatti P.S.
