27-03-2019 Heard Sri Arun Kumar Lal, learned counsel for the petitioner and Sri Shailendra Kumar, learned Addl. Public Prosecutor.

The present petition has been filed under Section 439(2) of the Code of Criminal Procedure, 1973, with a prayer to cancel order dated 28-09-2018 passed in Cr. Misc. No. 60281 of 2018. By the said order, this Court had extended the privilege of anticipatory bail to opposite party no. 2. Learned counsel for the petitioner tried to persuade the Court that even after release from the said case, the opposite party no. 2 has indulged in committing another crime, for which, a separate F.I.R. has also been lodged by the nephew of

Patna High Court CR. MISC. No.11061 of 2019(5) dt.27-03-2019 2/2 the petitioner.

Besides hearing, I have also examined the material on record and after going through the same, I am of the opinion that on such frivolous ground, an order, which has already taken effect, may not be reviewed or recalled.

The petition stands dismissed.
