1. Learned counsel for the petitioners, after arguing vehemently for some time realizing his difficulty seeks permission to with the anticipatory bail application with respect to petitioner no. 1, namely, Yasuddin @ Gyasuddin @ Bikau

2. Permission is accorded.

3. Accordingly, the anticipatory bail application is dismissed as withdrawn with respect to petitioner no. 1.

4. Heard learned counsel for the petitioners no. 2 to 10and learned A.P.P. for the State.

5. The petitioners no. 2 to 10 apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 109, 303(2), 74, 352, 351(2) and 351(3) of the BNS.

Learned counsel for the petitioners submits that petitioners no. 3, 4 and 6 are women and petitioner no. 6 is aged about 18 years while petitioner no. 8 is aged about 70 years and petitioner no. 10 is aged about 86 years and petitioners no. 2 to 10 are persons with clean antecedent and the informant alleges that goats of the petitioners were grazing the vegetable of the informant and on protest petitioners started assaulting her when Md. Israil came to save her accused Yasuddin assaulted him by bamboo causing injury on head. Thereafter, all the accused persons assaulted the informant and Nezamuddin Miyan (petitioner no. 5) snatched her chain and Rs.2,000/- from her husband.

7. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to grazing of vegetable by the goats. It is further submitted that no specific allegation of assault is alleged against the petitioners. It is next submitted that petitioners are not the criminals and have been implicated with general and omnibus allegation.

8. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

9. Considering the submissions made by the learned counsel for the petitioners, let the petitioners no. 2 to 10 abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Gadeihiya Bazar P.S. Case No. 85 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS. (Satyavrat Verma, J) Kundan/- U T
