JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 307, 341, 323, 325, 326, 504 and 452/34 of the Indian Penal Code. It is alleged that the petitioners and one Fekan Yadav abused the informant and on protest being made, the petitioners caught hold of the informant and then all the three accused assaulted with axe and lathi causing head injury to the informant. It is submitted by learned counsel for the petitioners that for the occurrence of 08.11.2014 the FIR was registered on 13.11.2014. As per the FIR, the victim was first taken to Magadh Medical College, Gaya and thereafter referred to PMCH. Though, the injury report suggests that the informant was examined by
Patna High Court Cr.Misc. No.10400 of 2015 (2) dt.24-04-2015 2/2 some private doctor where the injury of the informant was found to be stitched, though one injury has been found to be grievous. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Rafiganj P.S. Case No. 167 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
