JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 This application, for grant of anticipatory bail, arises out of Bhagwanpur P.S. Case No. 63 of 2019, disclosing offences under Sections 341, 323, 325, 436 and 34 of the Indian Penal Code.

Prosecution case is that petitioner and other accused persons came armed with lathi and danda and assaulted the informant and when his daughter came to save him, she was also assaulted by the accused Ramesh Rai due to which she sustained fracture injury, thereafter on 18.03.2019, they again came and set the house of the informant on fire. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no specific allegation has been attributed to him and there is delay of two days in lodging of F.I.R. Further submission is that petitioner is

Having heard both sides, in view of the above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bhagwanpur P.S. Case No. 63 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
