ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.07.2019 in connection with Hussainganj M.H. Nagar P.S. Case No. 189 of 2019 registered for the offence under Sections 272,273,420 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not made not from the conscious possession of the petitioner but from the joint house of the petitioner. It is further submitted that petitioner has one other similar antecedent but in that case also he has been granted bail. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

No.55229 of 2019(2) dt.13-09-2019 2/2 bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II cum Special Judge, Excise, Siwan, in connection with Hussainganj M.H.
