JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Mansoorchak Police Station Case No. 19 of 2013 registered for the offences punishable under Sections 341, 323, 379, 307/34 of the Indian Penal Code.

Petitioner is not named in the first information report and as per submission on her behalf, the name of the petitioner came in supervision note of higher police officials. According to first information report, petitioner was neither present on the place of occurrence nor participated in the alleged crime and, therefore, the application of provision of SC/ST Prevention of Atrocities Act against the petitioner appears to be

Accordingly, petitioner, in the event of her arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Mansoorchak Police Station Case No. 19 of 2013, subject to condition as laid down under Section 438(2) of the Cr.P.C.
