JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Special N.D.P.S. Case No. 19 of 2022, arising out of Forbesganj P.S. Case No. 646 of 2022 registered for offence punishable under sections 8/20 (b) (ii) (c) of the N.D.P.S. Act read with section 25 (1-b) A/26/35 of the Arms Act. As per FIR, one loaded pistol was recovered from the possession of the petitioner and 30 Kg. of Ganja was also recovered from the dickey of his vehicle.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent.

The petitioner was arrested at the spot with one pistol and 30 Kg. of Ganja was recovered from his vehicle in which three persons were also boarded.

Considering the fact that a huge quantity of the Ganja was recovered from the vehicle of the petitioner. In my view, the petitioner does not deserve the privileges for regular bail. Accordingly, it is rejected.

The learned court below is directed to take all the efforts to dispose of the trial as expeditiously as possible. (Nawneet Kumar Pandey, J) Mahesh/- U T
