07-03-2022 Heard learned counsel for the parties.

The petitioner seeks bail in Banka P.S. Case No. 862 of 2019 (G.R. No. 3401 of 2019), registered for the offence under Section 328, 302/34 of the Indian Penal Code. It is a case of dowry death and petitioner is married sister-in-law (uun) of the deceased.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. Petitioner is living separately with her family in other village and has got no concern with the family affairs of deceased and her husband. It is further submitted that husband of the deceased has already been acquitted by the court below on 17.11.2021. Petitioner is in custody since 16.06.2021.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Banka P.S. Case No. 862 of 2019 (G.R. No. 3401 of 2019).
