The petitioner seeks bail in Bela P.S. Case No. 279 of 2017, registered for the offence punishable under Sections 395, 397 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, seven miscreants after breaking the lock of the main gate entered the hospital, assaulted the informant (Doctor) and looted cash, mobile, computer, LED TV and other articles and fled away.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Md. Modim Mansoori. No looted article has been recovered from possession

Patna High Court CR. MISC. No.70281 of 2021(3) dt.25-04-2022 2/2 of this petitioner. Till date petitioner has not been put on test identification parade. Petitioner is in custody since 12.10.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sadar Sitamarhi in connection with Bela P.S.
