2. The petitioner has preferred this application for grant of regular bail in connection with Triveniganj P.S. Case No. 454 of 2023 dated 20.11.2023 registered for the offences punishable u/ss 370A, 376, 506 read with section 34 of the Indian Penal Code and Sections 3, 4, 5 of immoral Traffic (Prevention) Act 1956 and Sections 4 and 6 of POCSO Act.
3. As per the prosecution case, on 20.11.2023 the informant (Dharamveer Kumar Sathi, Addl. S.H.O. P.S. Triveniganj, Saupal) received information, that co-accused Panchanand Yadav along with the petitioner and the other
Patna High Court CR. MISC. No.64932 of 2024(2) dt.21-09-2024 2/3 co-accused persons were running their business of prostitution in their old Cinema Hall. Thereafter, a raid was conducted in the cinema hall, the entire Cinema Hall was searched and Police recovered used condoms and mobile phones of the victim and prepared the seizure list accordingly.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is a lady. It is further submitted that as per the F.I.R., the allegation is that the petitioner and the co-accused persons supported the co-accused Panchanand Yadav in prostitution work. The other co-accused person has already been granted bail by this Court vide order dated 10.05.2024 passed in Cr. Misc No. 21907 of 2024. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.11.2023.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and
Patna High Court CR. MISC. No.64932 of 2024(2) dt.21-09-2024 3/3 circumstances of the case, the nature of allegation levelled against the petitioner and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul, in connection with Triveniganj P.S. Case No. 454 of 2023.
7. The application stands allowed.
