JUSTICE BIRENDRA KUMAR ORAL ORDER 17-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

Petitioner is owner of the truck from which rice was seized. The driver of the truck informed to the police that he had loaded the rice from the referred rice mill but the driver has not stated anything that the petitioner had knowledge or was involved in the movement of the rice as claimed. Considering the merit of this case, the petitioner was already allowed provisional anticipatory bail on 05.11.2019 while calling for case diary. The case diary discloses no other

Patna High Court CR. MISC. No.63885 of 2019(3) dt.17-12-2019 2/2 material against the petitioner. Hence, provisional anticipatory bail is hereby confirmed in connection with Muraliganj P.S.Case No.132 of 2019 pending in the court of learned Chief Judicial Magistrate, Madhepura.
