JUSTICE NANI TAGIA ORAL ORDER 19-09-2024 The petitioner, who is working as an Assistant in the office of District Education Officer, Gopalganj, is seeking his transfer to the Government Sanskrit High School, Chhapra on the ground that in the office of District Education Officer, Gopalganj, the District Programme Officer is verbally directing the petitioner to put his signature on cheque with one another employee, namely; Ajit.

2. Learned counsel for the petitioner contends that on 26.10.2023, the District Programme Officer again called upon Mr. Ajit and gave him direction to prepare a cheque and

The petitioner further contends that similarly, one Zaved, who was an employee of the office of the District Education Officer, Gopalganj was to be issued one L.P.C. (Last Pay Certificate) and the District Programme Officer again pressurized the petitioner to put his signature on the L.P.C.

3. The reasons, as stated hereinabove, on which, the petitioner is seeking transfer from the office of District Education Officer, Gopalganj to the Government Sanskrit High School, Chhapra is absolutely untenable in law.

4. As such, the instant writ petition, being devoid of merit, stands dismissed with a cost of Rs. 2,000/- to be deposited before the Patna High Court Legal Services Committee.

5. However, it shall be open for the petitioner to lodge a complaint against the District Programme Officer, Gopalganj, if the District Programme Officer, Gopalganj is forcing the petitioner to sign on a cheque or other documents, which the petitioner is not supposed to do under the law.
