JUSTICE ARUN KUMAR ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under Section 47-A of Bihar Excise Act. Allegation in brief is that 5 litre of country made Mahua liquor and 10 Kg. Jawa Mahua were recovered from the house of the petitioner.
Learned counsel appearing on behalf of the petitioner submits that petitioner is a woman and she has no connection with the recovered liquor.
The petitioner being the sole occupant of the house wherefrom the recovery was made so her prayer for anticipatory bail is rejected in connection with Excise Case No.47 of 2016 pending in the court of A.C.J.M. 1st, Arwal.
Patna High Court Cr.Misc. No.5411 of 2017 (2) dt.06-02-2017 2/2 However, the petitioner may surrender before the court below and the same shall be considered on its own merit without being prejudiced by this order.
