2. Learned counsel for the petitioner submits that petitioner has given instruction that this case is covered by the order dated 07.07.2020 passed by this Court in CWJC No.10633 of 2019, titled as Lalan Prasad Singh Versus the State of Bihar and Ors.

3. Considering the aforesaid submission made on

Patna High Court CWJC No.13525 of 2023 dt.04-10-2023 2/2 behalf of petitioner, the Municipal Commissioner, Samastipur is directed to call for the service particulars of the petitioner and thereafter verify as to whether the case of the petitioner is covered by the decision rendered in Lalan Prasad Singh (Supra). In case, the case of the petitioner is similar to Lalan Prasad Singh (Supra), then the retiral dues, as claimed for in the present writ petition, are required to be paid to the petitioner within a period of four weeks from the date of communication of this order.

4. In case, the authority finds that the case of the petitioner is not identical to that of Lalan Prasad Singh (Supra), then an opportunity of hearing is required to be given to the petitioner and thereafter he will pass a reasoned order in accordance with law within the aforesaid period.

5. With aforesaid observation and direction, the writ petition stands disposed of.
