JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act. It is alleged that on the information of Barhu Yadav that Kerosene oil was being transported from the PDS shop of the petitioner, fifty liters kerosene oil were seized from a Tata Magic vehicle.
It is submitted by learned counsel for the petitioner that the seizure was made at the behest of Barhu Yadav with whom the petitioner is on serious inimical terms. Admittedly, without verifying the stock of the petitioner the accusation has been levelled. The stock of the petitioner was found in order. Statement has been made in paragraph of the petition that the
Patna High Court Cr.Misc. No.27705 of 2014 (6) dt.02-02-2015 2/2 petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bagaha, West Champaran in connection with Dhanha P.S. Case No. 25 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
