JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-04-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Katihar Sahayak P.S. Case No. 593 of 2016 for the offences punishable under sections 364, 365 and 120 (B) of the I.P.C.

Allegedly, the son of the complainant being driver of Indigo Car of the petitioner was sent by the petitioner and became traceless and it is alleged that the petitioner has got kidnapped him.

Submission is of false implication and that the petitioner has filed a case against son of the complainant/ Informant and then she has filed this case, the Indigo Car and the

Patna High Court Cr.Misc. No.8647 of 2017 (3) dt.07-04-2017 2/2 driver both are traceless and it appears that the driver has taken away the Indigo Car and is doing business elsewhere, the I.O. of both the cases has found the case true, the petitioner has got no criminal antecedent and he being the owner of the vehicle deserves sympathetic consideration.

The learned A.P.P. submits that the investigation is still going on and the driver with vehicle is still traceless. In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Katihar in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
