The petitioner is in custody in connection with Mainatadh P.S. Case No. 27 of 1993, registered for the offence punishable under Section 394, 411 of the Indian Penal Code and Section 25 (1-B) 26/27 of the Arms Act.

Learned counsel for the petitioner submits that earlier petitioner was granted bail by the Court. He further submits that during course of time petitioner left to Ludhiana for his livelihood and advocate looking after the matter left the proper Parvai of the case as such bail bonds of petitioner was cancelled by the Court. When petitioner return back his native place he was arrested on 16.7.2018. He further submits that trial is going on.

No.3341 of 2019(2) dt.24-01-2019 2/2 Considering the fact that petitioner is in custody since 16.7.2018 and earlier he was granted bail, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned S.D.J.M, Bettiah, West Champaran in connection with Mainthadh P.S. Case No. 27 of 1993 (Session Trial No. 8/17) subject to condition that (a) The bailors should be family members and (b) he is required to assist in the instant case on regular basis and in case he failed to appear on the date fixed without any cogent reason, the Court below shall be at liberty to cancel the bail bond.
