The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the IPC.

The prosecution case is that the petitioner took Rs. 1.5 lac from the petitioner on assurance to provide employment in Government Elementary, School, but neither the employment was provided to the petitioner, nor the money was returned. It is submitted by learned counsel for the petitioner that there is no proof with regard to making payment to the petitioner. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.58946 of 2019(4) dt.16-11-2019 2/2 Learned APP, after going through the case diary, submits that the petitioner had given receiving of money on stamp paper. Considering the fact that the informant wanted to get employment through illegal means, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned SDJM, Sikarhana at Dhaka, East Champaran in connection with Kundwa Chainpur P.S. Case No. 27 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
