JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Ghoshwari P. S. Case No. 06 of 2011, disclosing offences under Sections 395 & 397 of IPC. As per F.I.R. 7-8 miscreants intercepted the truck of the informant, taken away Rs.5000/-, mobile phone and they have also looted away on the truck. Petitioner is not named in the F.I.R. Later on, his name transpires on the confessional statement of the co-accused.

Submission of the learned counsel for the petitioner is that the occurrence is of the year 2011 and except the confessional statement, there is nothing against this petitioner. Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that unless the petitioner appears the TIP may be conducted and as such, the custodial interrogation of the petitioner is required in this case.

Patna High Court CR. MISC. No.62802 of 2019(2) dt.15-10-2019 2/2 Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner.
