2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 25(1-A), 25(1-AA), 25(1-B) and 26(1)(ii)/35 of the Arms Act.

3. The case of prosecution, in short, is that, a raid was made by the informant on the basis of confidential information and apprehended two co-accused persons, namely, Brajesh Sharma and Lachho Kuar and recovered one Barrel, two half manufactured plate, one iron rod which clearly shows that the arms were manufactured at that place. This led to the FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that nothing has been recovered from the possession of the petitioner and his name has

Patna High Court CR. MISC. No.62634 of 2025(3) dt.28-11-2025 2/2 surfaced in the confessional statements of the local villagers. Moreover, the petitioner is languishing in judicial custody since 05.06.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of six cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ayer P.S. Case No. 55 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Bhojpur at Ara/concerned Court below, with a condition:- (i) the petitioner shall co-operate in the trial and shall present himself in the trial Court whenever required.
