JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-05-2015 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341/323/324/307/448/380/385/504/506/34 of the of the Indian Penal Code.

It is alleged that in a quarrel between the children, the

No.13877 of 2015 (2) dt.08-05-2015 2/2 co-accused Ram Udgar Yadav @ Bhultun Yadav assaulted on the head of the informant with 'farsa' when son of the informant came to rescue, the petitioner Dev Narayan Yadav assaulted him with the butt of the pistol. Though there is omnibus and general accusation of assault against them.

It is submitted by learned counsel for the petitioners that there is counter version of the occurrence also. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below. Considering the case and counter case and retracted version of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Navhatta P.S. Case No.18 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
