Mr.Rajendra Prasad Nat, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 109, 303(2), 352, 351(2) and 3(5) of B.N.S., 2023.

3. The prosecution case, in short, is that on 17.05.2025, at about 06:10 p.m., when accused Mithun Paswan (petitioner No.3) was crossing the house of the informant,

Patna High Court CR. MISC. No.61994 of 2025(2) dt.11-09-2025 2/3 husband of the informant demanded his money which the accused had taken. He flatly refused to give the money and abused him. On protest, accused Sanjay Paswan, Baban Paswan and Bipin Paswan, armed with lathi, danda, Garasa, came there and assaulted husband of the informant. In course of assault when nephew of the informant Ram Prasad Paswan came to rescue him, all the accused persons assaulted him and snatched Gold chain and threatened him of dire consequences.

4. Learned counsel for the petitioners submits that allegation of assault is general and omnibus. Injuries sustained by the injured are simple in nature. Petitioner Nos. 1 to 3 have got clean antecedent and petitioner No.4 has one antecedent in which he is on bail.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the nature of injuries, let the above named petitioners, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur, Bhabua, in connection with Bhabhua P.S.
