This application, for grant of anticipatory bail, arises out of Murliganj Police Station Case No. 335 of 2016, disclosing offences under Sections 406 and 420 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, has falsely been implicated in this case. In fact, the petitioner has never taken rupees for the sale of alleged motorcycle. Neither anything has been recovered from the possession of the petitioner nor the petitioner is the owner of any motorcycle. Hence, the petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.7800 of 2017 (3) dt.08-04-2017 let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Murliganj Police Station Case No. 335 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
