The petitioner seeks anticipatory bail in connection with the Mahila P.S.Case No. 85 of 2018 corresponding to G.R. Case No. 3375 of 2018, registered for offences punishable under Sections 341, 323, 504, 506 and 354 (B) of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is that the petitioner misbehaved with the informant, who is minor. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and there was delay in lodging the F.I.R. without giving any plausible reason and the police has submitted charge sheet against the petitioner along with two other F.I.R. named accused persons and the petitioner has no criminal antecedent.
Patna High Court CR. MISC. No.5549 of 2019(3) dt.27-03-2019 2/2 Heard learned A.P.P. as well as the informant, who opposes the prayer for bail.
Having considered the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of six weeks from the date of receipt of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court and if possible to be disposed of on same day.
This application is accordingly disposed of.
