2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 498A of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
4. Learned counsel for the petitioner submits that vide order dated 17.02.2024 the matter was referred to the mediation centre and the dispute between the parties has been resolved through the process of mediation in terms of payment of one time settlement amount of Rs. 15,00,000/- which will be paid in equal installments. Learned counsel for the petitioner further submits that a cheque of Rs.3,00,000/- with regard to first installment has been handed over to the learned counsel for
Patna High Court CR. MISC. No.61397 of 2023(5) dt.09-04-2024 2/2 the informant today itself, which learned counsel for the informant accepts. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sadar P.S. Case No. 225 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
7. It is made clear that if the aforesaid cheque gets dishonoured, learned court below will be at liberty to cancel the bail bonds of the petitioner.
