JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, 2 litres of illicit liquor has been recovered from Daudnagar. Local chaukidar disclosed the name of the petitioner.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender

Patna High Court CR. MISC. No.59750 of 2022(2) dt.09-12-2022 2/2 before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court II-cum-Additional District and Sessions Judge, Vaishali at Hajipur in Bidupur P. S. Case No. 382 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
