The petitioner is in judicial custody in connection with Banka (Barahat) P.S. Case No. 138 of 2021 for the offences under Sections 366(A) and 376 of the Indian Penal Code and Section 4 of the POCSO Act.

As per the F.I.R, the informant has alleged that his minor 14 years old daughter was kidnapped by the petitioner herein and when they went to the accused person's home, they were abused.

Subsequently, the victim girl was recovered and she made a statement under Section 164 of the Cr.P.C. in which she

No.71413 of 2021(4) dt.29-08-2022 2/2 has supported the prosecution version and further has alleged that the petitioner herein forcibly made physical relationship with her and used to lock her in home before going for work. However, she successfully escaped from the place and reached her parents home.

Taking into account the aforesaid allegation that the minor girl has made a statement under Section 164 Cr.P.C., this Court is not inclined to grant him the privilege of bail which is accordingly rejected.
