1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Jakkanpur P.S. Case no.521 of 2021 (G.R. no.6821/2021) registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, the vehicle of the informant was overtaken by four accused persons who were travelling in a Maruti car and the informant was looted of the articles as mentioned in the F.I.R.

4. Learned counsel for the petitioner submits that the F.I.R. was registered against four unknown. The petitioner was falsely implicated in course of investigation on the basis of the confessional statement of co-accused Amit Kumar recorded

Patna High Court CR. MISC. No.66175 of 2023(2) dt.16-10-2023 2/2 before police. No incriminating article was recovered from the petitioner's possession and with respect to the allegation of the prosecution of recovery of the refined oil, it is stated that the same is from the joint family house. The petitioner is in custody since 13.3.2023. He has not been put on T.I. parade and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the material which has transpired in course of investigation as is evident from the order of the learned trial Court, the petitioner being in custody since 13.3.2023 and chargesheet having been submitted in the case without putting the petitioner on T.I. parade, the Court directs the petitioner to be enlarged on bail in connection with Jakkanpur P.S. Case no.521 of 2021 (G.R. no.6821/2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Patna.
