Mr.Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 23-01-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in Sahebganj P.S. Case No. 08/2017, instituted for offence under Section(s) 392, 302 of the Indian Penal Code read with Section 27 of Arms Act. It is alleged in the written report that on the date of occurrence Ravindra Kumar Ram (since deceased), who was working as D.B.O. (money collector) in Bandhan Bank, had gone alone from Bank for collecting money from village B. Kalyan Khoripakar on his bicycle. In the meantime, informant, who is working as head of the door step service centre in aforesaid Bank, received information on his mobile that Ravindra Kumar Ram is lying injured after receiving gunshot injury. Thereafter informant along with others reached at the place of occurrence and took Ravindra Kumar Ram to P.H.C.
Patna High Court Cr.Misc. No.2922 of 2019(2) dt.23-01-2019 2/2 and subsequently to S.K.M.C.H., Muzaffarpur, where he was declared dead.
Learned counsel for the petitioner has submitted that petitioner is not named in the written. His name has come in the confessional statement of co-accused Md. Rustam and Md. Imam, who were arrested during course of investigation. Co-accused Md. Rustam has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 40785/2017 dated 19.09.2017.
Petitioner is in custody since 10.09.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 8th Addl. Sessions Judge, Muzaffarpur, in connection with Sahebganj P.S. Case No. 08/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
