The petitioner is languishing in custody in a case registered for the offences punishable under Sections 290, 354(A), 387, 506, 34 of the Indian Penal Code and Section 8 of the Protection of Children From Sexual Offences Act.

The prosecution case as per F.I.R is that his grand-daughter aged about 13 years was standing near his house, in the meantime, ten boys who were in drunken condition came there and started misbehaving

Patna High Court CR. MISC. No.58654 of 2022(3) dt.20-02-2023 2/3 with her. They threatened her and asked her to bring the gold and money kept in the house, on which the victim opposed and started shouting loudly. On her noise, the people of the vicinity gathered there and apprehended the petitioner and handed over to the police. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner has not committed any wrong to the victim. The petitioner is languishing in custody since 28.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the nature of accusation and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Exclusive Special Court (POCSO Act), Patna in connection with Danapur P.S. Case No.

Patna High Court CR. MISC. No.58654 of 2022(3) dt.20-02-2023 3/3 595 of 2022.

The bail bonds of the petitioner will be accepted by the learned Court below on filing affidavit by the petitioner to the effect that he will not involve in any other criminal case of similar nature.
