The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 504, 506, 354 and 379 of the Indian Penal Code.
It is alleged that accused persons entered into the house of the informant. The petitioner snatched golden chain and gave threat to kill the informant and their family members and earlier the petitioner tried to outrage the modesty of the informant.
It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. The father-in-law of the informant
Patna High Court Cr.Misc. No.14798 of 2015 (2) dt.13-04-2015 Murlidhar Pandey and others filed Title Suit No. 660 of 2010, in which the petitioner and his family members are defendants and there is nothing on record. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent and due to land dispute the petitioner is the next door neighbour, the accusation has been levelled. Considering the fact that the accusation is levelled in the pending Title Suit, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 509 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
