The petitioner apprehends his arrest in Bhagwanpur P.S. Case No.206 of 2016 registered under Sections 363 and 366A of the Indian Penal Code.

The informant alleged that the marriage of his daughter was settled and date was fixed for marriage on 25.11.2016 but on 19.11.2016 at night the accused persons including the petitioner kidnapped his daughter with intention to marry her.

The learned counsel for the petitioner submits that the petitioner is named in the F.I.R. but the name of petitioner did not figure in the statement of the victim recorded under section 164 of the Cr.P.C., but it appears that the learned Sessions Judge stated that the petitioner has remained absconding in the case.

Patna High Court CR. MISC. No.55228 of 2019(2) dt.04-09-2019 2/2 Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this court.
