1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Rahui Police Station Case No. 290 of 2023, disclosing offences under Sections 147/148/149/323/307/353 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 10.07.2023, the police team arrived at the house of the co-accused Ranjit Kumar Yadav, along with warrant for his arrest. The co-accused Ranjit Kumar Yadav and his brother Indradeo Yadav, along with their wives and eight to ten unknown persons assaulted the
Patna High Court CR. MISC. No.62586 of 2023(2) dt.17-10-2023 2/3 police force and created hindrance in the official duty of the police due to which two Bihar Home Guard personnel sustained injuries.
4. Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in the present case by the police, along with their husbands. He further submits that the petitioners are wives of the accused Ranjit Kumar Yadav and his brother Indradeo Yadav. The injury caused to the constables are minor, as would be evident from the injury report annexed at page nos. 14, 15 and 16 to the application.
5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that the petitioners are women, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Additional Chief Judicial Magistrate-I, Nalanda at
