JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-05-2015 All the above stated petitions are taken en-bloc as the said petitions have arisen out of Dhamdaha P.S. Case No. 128 of 2014 registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120B, 295A of the Indian Penal Code and accordingly, all the above stated petitions are being disposed of by this common order.
Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The only accusation against these petitioners is that they abetted the informant and several other persons to deposit their money with co-accused, Girija Devi and almost all the victims of this case stated that they deposited their money with coaccused, Girija Devi. Moreover, having more or less similar allegation, co-accused, Bhairav Kumar has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, these anticipatory bail petitions are allowed and it is ordered that petitioners, in the event of their
arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Dhamdaha P.S. Case No. 128 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
