JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 324, 307, 34 of the Indian Penal Code. The prosecution case is that petitioner No. 1 assaulted the informant with farsa on his head, whereas petitioner No. 2 assaulted Reyaj with iron rod. It is submitted by learned counsel for the petitioners that though petitioner No. 1 is alleged to have assaulted with farsa to the informant but the injury has been found to be lacerated, simple in nature, whereas injury of Reyaj has also been found to be simple in nature. The impugned order reflects that informant appeared and suggested that now they have settled the issue. It is further submitted that there is no accusation of repeating the blow.

Patna High Court Cr.Misc. No.24435 of 2016 (2) dt.31-05-2016 2/2 A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the retracted version of the informant, it is a case for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Pupri P.S. Case No. 85 of 2013, pending in the Court of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi.

It is expected from the learned Court below to dispose of the regular bail of the petitioners preferably on the same day.

With the observations above, the application stands disposed off.
