JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-09-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 341, 323, 379 and 504 of the Indian Penal Code.

It is a case of assault upon the husband of the informant with the iron rod and also the accused persons stolen Rs.10,000/- and gold items from her house.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is general and omnibus allegation against the petitioner along with other accused persons of assaulting to the injured, namely, Anwar Hussain. From perusal of the injury report attached with the case diary, it appears that

No.70336 of 2021(3) dt.08-09-2022 2/2 there is injury of swelling over occipital region of scalp of the injured and he also sustained injury on head but there is no specific allegation against the petitioner of assaulting upon the head of the husband of the informant. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur (Patna) in connection with Dulhin Bazar P.S. Case No. 114 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
