The petitioner seeks bail in anticipation of his arrest in connection with Maharajganj P.S. Case No. 185 of 2018 dated 15.09.2018 instituted for the offences under Sections 272, 273 and 308 of the Indian Penal Code and under Section 41(i) of the Bihar Prohibition and Excise Act.

After some arguments, learned advocate for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed on behalf of the petitioner, the court below shall take into account that the petitioner does not have any criminal
