====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 24-03-2021 This Court, vide order dated 22.01.2021, had directed the Principal Judge, Family Court, Bhojpur at Ara to decide Matrimonial Case No. 9 of 2017, titled as Preety Kumari Vs. Rajeev Kumar, within a period of six months. The concerned Judge has sent a written communication dated 16.1.2021, requesting for extension of the period for the period of twelve months. The reason for seeking extension of time, as stated in the communication, reads as under:
"I further submit that I joined at Ara as Principal Judge, Family Court on 23.03 2020, after that the pandemic COVID -19, spread all over the world as well as in Ara. Due to that pandemic the parties have left their 'pairvi' till date. This record was produced before me on 12.01 2021 for the first time. The record is still
Patna High Court C.Misc. No.58 of 2019(3) dt.24-03-2021 2/2 pending on the stage of petitioner's evidence since no evidence have been adduced by the petitioner side as yet. The Pandemic is still affecting the normal work. Parties are still absent and the progress of the case has stopped hence more time will be required to dispose off the case.
It is therefore humbly requested to extend the time to conclude the trail for 12 months further from today, and for such act of kindness I shall ever pray."
Taking a holistic view, the time, as prayed for, is extended and the matrimonial case be positively decided on or before 16th January, 2022.
Let this order be communicated to the Court concerned as also learned counsel for the parties. This application stands disposed of.
