2. Petitioner seeks regular bail in connection with S.T. No. 97/2025, arising out of Bihar P.S. Case No. 717 of 2024 in a case registered for the offences punishable under Sections 137(2), 140(3), 109, 3(5) of the B.N.S. and section 27 of the Arms Act. Later on section 103(1), of the B.N.S. was added.

3. As per prosecution story, informant suspects that this petitioner along with co-accused Jitendra Yadav kidnapped and killed the son of the informant due to previous enmity.

4. Learned counsel for the petitioner submits that the informant is not an eye witness of the occurrence and only a suspicion has been raised against this petitioner because of litigation. As per postmortem report the cause of death is

Patna High Court CR. MISC. No.57647 of 2025(4) dt.07-11-2025 2/2 asphyxia due to drowning. Petitioner is in custody since 30.09.2024.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-cum-Special Judge, Nalanda at Biharsharif/successor court in S.T.
