JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-02-2019 The petitioner has a grievance against a communication made by the Circle Officer, Dhoraiya, in the district of Banka, whereby he has asked the petitioner to remove the encroachment, which he has caused on a Government nala. Learned counsel appearing on behalf of the petitioner has submitted that he is being unnecessarily harassed as the land in question, which has been referred to in the said letter dated 11.09.2018, does not belong to the petitioner. It is accordingly his contention that action of the Circle Officer is against law. In my view, the petitioner has effective alternative statutory remedy under Bihar Right to Public Grievance Redressal Act, 2015. Under the provisions of the said Act, a person, who has a grievance that something is being done in

Patna High Court CWJC No.2078 of 2019(2) dt.05-02-2019 2/2 violation of any law, can approach Public Grievances Redressal Officer, as notified under Section 3 of the Act. This application is disposed of with the observation that the petitioner shall be at liberty to approach the competent authority in this regard.
