JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Dhansoin P.S. Case No. 66 of 2014 registered for the offences punishable under Sections 341, 323, 448, 447, 504, 379/34 of the Indian Penal Code.

Allegedly, the petitioners after entering into the house of the informant assaulted him and abused the female inmates. Petitioner no. 1 assaulted Binod on his head by wood portion of the spade and petitioner no. 2 snatched gold chain from his neck and when the villagers came the life was saved.

Patna High Court Cr.Misc. No.29530 of 2014 (2) dt.12-01-2015 Submission is that both the informant and petitioners are agnates and due to land dispute and partition of ancestral property they have been implicated. All the offences are bailable except Section 379 IPC which is supper addition which is against petitioner no. 2 to which the learned APP does not oppose. In the facts and circumstances stated above, the petitioners, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Dhansoin P.S. Case No. 66 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
