Unfortunately, no one had appeared on behalf of the petitioner and in order to facilitate counsel for the petitioner to appear and assist the Court, today the case has been listed under the heading "For Dismissal". Unfortunately, even today no one has appeared on behalf of the petitioner and as such the Court is constrained to decide the writ petition on the basis of the materials available on the record.

Patna High Court CWJC No.16172 of 2013(3) dt.18-09-2018 2/2 respondent submits that the issue of inter se seniority is now no more pending as the University has already decided the inter se seniority of the petitioner and the respondent and the respondent has been declared as senior to the writ petitioner. In addition thereto, the dispute as to Professor Incharge in the college in question has lost its significance as the respondent has retired on 13.6.2015 and the petitioner also retired on 13.9.2016. In view of the above, the present writ petition has become academic and does not merit any adjudication. Accordingly, the writ petition is dismissed as having been rendered infructuous.
