The petitioner apprehends his arrest in connection with Katoria P.S.Case No.174 of 2013 registered under sections 304B, 328/34 of the IPC.

The father of the deceased alleged that his daughter was killed by her husband (petitioner) for not delivering a child. It is alleged that the petitioner poisoned his daughter as he was torturing her.

It is submitted that the marriage was solemnized five years ago. The police, after investigation, submitted charge sheet under section 306 of the IPC.

Considering the facts that the petitioner is the husband and his wife died within five years of the marriage on being tortured by the petitioner, I am not inclined to enlarge the petitioners on anticipatory bail and accordingly, the same is rejected.
